Advocate says sexual harassment is widespread

Lesa Donnelly is no stranger to the way things work for women in the Forest Service. From her perspective, white men end up in the positions of power, and those women who manage to do so as well do so only by playing the game. 

Donnelly knows, she said, because for 24 years she worked in an administrative capacity for the U.S. Forest Service and during that time, she was sexually harassed. Now, she works to help other women as a civil rights advocate, taking on cases of people who have been sexually harassed and discriminated against, cases like Alicia Dabney, 30, a fire fighter that was recently fired from the Forest Service.

"I've been doing this advocacy for almost 20 years," Donnelly said. "And Alicia's case is one of the most egregious that I have seen."

Dabney, 30, who was assigned to the Springville Work Station, stands out, Donnelly said, not just because of the seriousness of her case, but because Dabney herself is so vocal.

"Alicia is an anomaly. Most of the women sit there and take it because they need the job. They are single mothers, they have children to feed. They need the health benefits," Donnelly said. "I have women tell me 'I am not going to file a complaint because my child is ill and if I lose my health benefits, my child could die.' That is holding women hostage."

Donnelly has fought this fight for herself. In 1995, she led a class action lawsuit representing 6,000 women with sexual harassment complaints against the Forest Service, which is a part of the Department of Agriculture. Though this case was settled in favor of the complainants, things have not changed for women in the Forest Service, she claims. Donnelly said women are treated horribly, complaints are filed, and the agency does its best to ignore the problem or discredit the person making the complaint. Donnelly said that in the case of Alicia Dabney, the agency has done both.

Dabney has tried to contact Kevin Elliot, the current Sequoia National Forest supervisor, but has been unable to speak with him on any of the issues. Donnelly is not surprised, as Elliot has been a part of mediation cadres that Donnelly has tried to settle with in past mediations.

"I have never settled a case with him," she said. She added the Sequoia National Forest region is either one of, or the worst region in terms of the amount of complaints.

"He (Elliot) has a lot of discrimination complaints on that forest from women and minorities," Donnelly said, adding that Dabney's experiences fall under both categories, as she comes from Comanche roots, grew up on the Tule Reservation, and is married, with children. "They have treated American Indians abominably."

National Problem

Not that the problem is just local: Donnelly has received calls from women all over the state, from Angeles National Forest to around Redding, alleging everything from sexual harassment and assault to sex discrimination. Donnelly is aware of at least 100 complaints from California alone, filed about the Forest Service to the Equal Employment Opportunity Board.

"Region 5, which is all of California, has the highest number of EEO complaints in the nation," Donnelly said.

Donnelly said that the Forest Service also has the highest number of complaints of any of the USDA agencies, and that the number that have actually been made is nothing compared to the incidents which go unreported, out of fear of retaliation. Donnelly says that there are witnesses that could speak for Dabney, but are afraid to because of "the chilling effect."

Many of the problems Dabney has faced, Donnelly said, are forms of retaliation because of an initial complaint she made in 2010 while she was still an apprentice studying at the Wildland Fire Academy at McClellan Air Force Base, and because Dabney has continued to be "very vocal" since then. That complaint was investigated in the fall of 2011, and Dabney was dismissed from the academy shortly after. Donnelly says that since then, the Forest Service has acted out of a desire to keep the problem secret, so the agency will avoid being taken to court.

"Sexual harassment is against the law. That's one thing that the agency gets nervous about, because the courts are harder on them with sexual harassment then they are for mere discrimination," Donnelly said. "It is harder to prove that you discriminated against me because I am black or Hispanic. Sexual harassment is easier to prove when you have evidence. They are supposed to take it more seriously. Unfortunately they took it seriously by retaliating against her (Dabney) and trying to discredit her."

Discrediting Dabney is better in the long run, Donnelly said, because the alternative would be to actually resolve the problem, which would cost the agency far more than it costs to lose a single person.

Because of a system of favoritism and nepotism, Donnelly explained, the Forest Service maintains misogynistic, macho culture, where new employees "think and act" just like the men who hired them. "They are going to have to remove a lot of these guys, and they (the agency) don't want to do that," Donnelly said. "So ... dealing with this problem is to get rid of her (Dabney)."

Donnelly said that locally, the Forest Service has taken things a step farther, by no longer being an equal opportunity employer.

"They are not going to have women on that crew ever again," Donnelly said of Dabney's crew. "That's discriminatory. There are other crews on this forest that they have not hired women on. Because they can't stop the men from harassing the women, they won't hire women on the crews."

Both Dabney and Donnelly attest that the attitude is instilled in the fire crews as early as their apprenticeships. Donnelly compares the culture to a fraternity, and she and Dabney said they have seen incidents that are very much like frat-boy behavior. 

Donnelly wants to make it clear that every time a woman in the agency is terminated, it affects everyone. Donnelly has used just about every connection she has to raise awareness, internationally, especially amongst officials in Washington D.C., on the issue, using Dabney's story. Donnelly has contacted civil rights activities, like Marsha Coleman-Adebayo, the woman who inspired the No FEAR Act (Dabney was given a No Fear Award in June) and USDA Coalition of Minority Employees president Lawrence Lucas. She's even found a way to try somewhat bypass the Office of Communications, and send e-mails directly to the White House in the hopes that the president or his administration will stand up and act.

"One thing he (the president) needs to be focusing on is keeping these women and minority employees working in an agency, so they are not going off on welfare," Donnelly said. In a time when people are already losing jobs, and are suffering emotionally because of money problems, Donnelly feels its important for those who are employed to continue to be that way. 

"She wants to work," Donnelly said of Dabney. "They have taken her out of a good job and are trying to make her an unemployed person, using the tax-based systems instead of putting money out into the community. When they let someone off, it hurts everyone in the community."

Donnelly's case in 1995 was settled, but the agency did not fully comply with the terms of the settlement, forcing Donnelly to take the Forest Service back to court with a motion of contempt, and then later, another lawsuit nearly a decade later. A press release announcing the 2004 lawsuit, on the www.agcoalition.org website, quotes Donnelly as saying that regardless of the court's rulings, women in the forest service continued to be sexually harassed. I

"This is 2012, how can people believe this." Donnelly exclaimed. "You'd think we'd be farther (as a society) than this."

I have also noticed the resemblance of the usda farm credit banks and programs with MERS. I do not know if anyone has a MERS decision related to Farmers and farmland.

the June 1972 congressional record of the Young Executive Report shows what they planned to do to the American Farmer's it didnt say black,white, native, it said American Farmer's. Known as the Plan to Liquidate the American Farmer.

the FmHA started a running record in the name of Jerry Seaver by making a call to the PCA where Jerry had a small operating loan, he did not own the land his unremarried widowed mother owned the land. this was the start of the Defrauding of the Seaver Family.
Jerry and Melissa (me) were married July 12, 1985. Between Christmas and New Years Jerry's sister(who worked as a loan specialist/Tech for the FmHA) suggested to him behind there mother's back behind closed doors for him buy there mother's land and take over her bills. The same situation was turned around and told to their mother who Jerry did not know nor she did not know the other had been told a variation of the story. He however did not go into the office until late Jan 1986 to pick up the package, then it was turned down
and the raised sealed blue ink document were given back to us, then they called back and said that a mistake had been made and wanted to bring this turned down loan back to life, we did not file new papers at this time. They put this loan into supervised bank account. We never got all of the money and we did pay money back (there was a bunch of mistakes made here)

Fast forward Jan 27 2007
Native Americans had been to the Mounds on the farm to help gain preservation for the mounds and to hold one of several sacred ceremonies at the mounds, the BIA carrying members of the of many tribes were refused the appropriate documents for the preservation nomination to the registry of historic places. An archaeological site number was established and a search was partially completed.
News articles concerning this came out in the Indianapolis Star, the second cup cafe news at the University of Indiana Bloomington Tv station came out and did a piece. An article came out from the Round About Madison News & Entertainment Guide came out on Feb 1 2007
which also was our only son's 18th Birthday sparking a county wide rebellion of sorts.

Feb 15th 2007 10AM a call from a farmer from Maine came in he said someone is on your line he gave me another number to call
and before the call could go through I noticed a sea of cars coming from the south. Before I could get to the door a loud bang on the door
came and a voice said Melissa You know why we are here! I opened the door and saw guns I told them not to hurt the baby he's only three! They came in threw me against the computer stand and cut my leg. I was handcuffed behind my back, and told it was for my protection (one guy was recording sound bites/ most everything was fabricated for their protection) they wore black Kevlar vest(s)
there was one women that I saw she kept spitting on me, I saw no badges on them except for (now former Scott County Indiana Sheriff
John Lizenby) led them into my home with no Court Order's, No Warrants search nor arrests!
The gun was at my young grandson's head and I feared for his safety.He was forced to watch as they physically searched my person,
they took my phone(s) from me. I asked them to arrest me, I was asked back why I wanted to be arrested I said if arrested, you have to give me my rights, and a phone call, their reply was 1) What TV show have you been watching? & 2) We weren't trained that way! and 3) who would you call?
They also stated that they knew by the GPS that Jerry My husband was at the local Diner Mariannes but he wasn't our oldest daughter had his phone she worked there! He was with his mother our other daughter was at the hospital she had a little baby girl on the 13th that we had not even seen they were trying to get the pictures that the other daughter had taken.

It was 14 degrees that day and after being searched and my clothing ripped up a woman put her filthy hands on my breasts and I told her
to take her hands off my breasts or I would hit her, immediately my arms were pumped up and down behind my back, until my right shoulder came out of socket. Then I was dragged outside I cried for my grandson who was sick and running a low grade fever and was thrown into an unmarked police car with doors standing open the woman had my coat on her arms. My arms were pumped up and down again as I was being told they were giving our farm to the rightful owners, our appeals were still in place(they refused to look at them said they couldn't read them)
I was in bad need to use the rest room, when after a very long time I was allowed to go back in 2 men went to the rest room with me
and one watched through the mirror, and the other directly at me I was being humiliated, I am a more reserved person than that
The man who seemed to be in charge was telling me that they weren't there to destroy our personal belongings or to steal them but yet he was using the baby's bathtub and filling it up with anything of value they could find knives scissors.they chose the clothing we could take
I was threatened over Jerry's gun safe for the key they threatened to destroy it also. Told they would put us in jail if we came back.

the electric was shut off freezing our water pipes in the barns and the house our livestock some died for it stayed extremely cold
the closest neighbor let our son carry water for two weeks to our hogs they had already run our reg angus cattle out and run them on a waiting cattle trailer and took them to the yards and sold them our son had to buy a pig and a calf to finish his last year in 4-H.

When they finally let us have our grandson back and we got him to my elderly mother in laws apartment to warm him when he woke up
he was bruised from his top of his shirt collar to the top of his pants.
My daughter who was in the hospital called as did the farmer call back they were both told to state their name(s) and business for calling that number, that it was being used for law enforcement. our daughter thinking it was some sort of joke until the man was yelling at her
she was needing a ride home from the hospital they never told us she took milk fever from the stress she and the new baby had to be readmitted. she called out son and he came home from work both he and my husband were frisked, and each did ask about court order's and all three time asked they said they didnt have one : meaning they had no authority on our place and everything they did was unlawful from trespassing, to physical assault with a deadly weapon, police brutality, criminal confinement, kidnapping, endangering a child, assault on a three year old a minor, theft and destruction of private and personal property, collusion, conspiracy to commit fraud, Violations of God Given Rights, Constitutional Rights, Native Rights, Civil Rights. to the right to be safe and secure in my home and to have the pursuit of life, liberty and the pursuit of happiness. (I am the 15th great granddaughter of Pocahontas, and the 6th great granddaughter of George Mason IV, Chief Red Bird and Squire Boone) three of those were soldiers or patriots in the American Revolution I come from a long line of Activists and what has happened to my family must stop! and must be set right.

I have been President of the Ag Society here in Kansas
for some years now.

It would take a lot of you time to being you completely
up to date.

I was involved in the determination of the Kansas Board of
Agriculture being unconstitutional and they were after me
for my wanting the Ag Society to not be usurped as we
seemed to be the only ones that were wanting to be
responsible for the protection of farmers.

The Farm Bureau has only been a insurance and usurption.

Then of course the Federal Land Banks as for the application
seems to not have an approved one and have also been
working just like MERS do you know the MERS decision.

Also the wall street paper has been seemingly tainted by
the other dealings of such fraud bigger than MADOFF.

Then the courts have now seemingly been exposed and
that was why we met with the KCMO law firm that was
telling us they wanted to help and they only wanted to
pick our brains.

Then I was researching and found more.

Thank you for explaining, I must say I was left in curious thought. To answer your question first things first I have never been to Kansas City Mo ever. I'm not working for nor have I ever worked for USDA in anyway. I have been to Sikeston, MO and spoke at a dinner panel in 1996 and Champlain,Ill in 1995 as well for Adopt A Farm Family of America(Rural Restoration Adopt) speaking on Family Farmer Issues such as USDA/Banker troubles etc.

Here it is straight up, I voted for Mr. Obama, I came to Senate and left my papers and concerns with his staff asking for his help, still today even though I talked people into voting for Mr. Obama I still cannot ask for help from his Administration and yet he allows his administration to subject Women from the Forest Service to sexual Harassment and to be raped, beaten and spit on, and in my own case my Husband's family owned this farm since 1914 and it had an arm of the Underground Railroad, Native Mounds, a Rare Brown Indiana Bat, a possible treaty spot between Wm Henry Harrison and Tecumseh, also the Forest classification made our land home to Deer, quail,woodcock,grouse,geese,duck,woodpecker,hawks and many varies of owl's, the IDNR also turned their rehabbed animals and even a pair of Eagles loose here on our ground. As per the 1907 United States Geological Survey all of Scott County has oil shale gas, and other valuable minerals with in 500 feet or less to the top of the surface of which our farm has a cornerstone that would allow someone the access point of 4 Sections with out informing other land owners. This is not acceptable! To allow this kind of practice to go on! You want my money for a campaign, you want my vote, then all I ask is you do what is right.

You also took it on your selves to give him a Stimulus check he would not have asked for, but since you put it in his saving account to gain access to his social security, for a loan we did not even get shame on you for taking part in such a scheme, make right the wrongs then ask me for campaign money, meet with us and the Coalition of Minority USDA Employees and Farmers, Meet with Lawrence Lucas and Lesa Donnelly. It isn't too late. Just Do what is Right, Stop the War on Woman & Stop the War On Whistlblowers, Stop the theft of Family Farms, don't allow the Legacy employees to Continue, Stop the collusion between the Federal (offices/officers) and State County and cit/town government to railroad the people of America. All persons who work in the USDA and other legislative branches of government should be moved around and instead of hiding the civil rights complaints fix the problem it is less costly instead of standing with the CULPRITS who are making you as NON COMPLIANT as they are.
Instead of asking me for money to put you and your children back in a lavish environment What about my 3 1/2 year old grandson who was with me when men with guns and Kevlar vests came in led by the (former) local county sheriff and put a gun to his head asked by three people they didn't have not even a court order they had no rights even being there but that little boy has been scared by them and is afraid of every kind of uniform because they harmed him physically and emotionally when they were shown documents that said they had no rights to be there they said they cant read it I wasnt arrested but handcuffed and treated like a common criminal spit on multiple times dragged into the 14 degrees temperature left to sit in a cold cop car w/ doors open threatened my arms were pumped up and down because I told the woman to remove her hands from my breasts or I would hit her the man holding my handcuffed hands(who said it was for my protection) pumped my arms up and down until my should came out of socket, two men watched me use the bathroom and change out of the clothes that was ripped while the searched me over and over. they took and destroyed heirlooms and our property was handed over to developers who used the usda livestock water grants to make houses and lakes on our land not for livestock water they even took down and never replaced any of the fences, they pillaged the Mounds and tore the grass to hide the Underground railroad-all because of greed, bonuses for foreclosures, and Non-Compliance of every level of the government.

Evy and David, I wish to state for the record that I have never met you and don't know you. I only came to know of your organization in the last two weeks.
The e-mails of the last few days have been very disturbing and utterly shameful. Perhaps, more appalling is the fact that it seems that my personal e-mail addresses have been hacked. I will request an investigation into the invasion of my privacy.
It is public record that the No Fear Coalition spearheaded the passage of the No Fear Act 10 years ago. It is also public record that the No Fear Coalition and the No FEAR Institute (under the leadership of former Congressman Walter Fauntroy) were the conveners of the first two Whistleblower Weeks in Washington in which a No Fear Data Report was issued focusing on the performance of various agencies. This data was analyzed and collated by members of our coalition who worked assiduously in generating data that resulted in the publication of the No Fear Report Card. The No FEAR Institute issued its latest No FEAR Data Report yesterday during the whistleblower conference in Washington, DC.

We have not required your assistance in the past nor will we have need of your input in the future.
At no time did I give you the impression that you or David were the first to generate No FEAR data. Two weeks ago, I was pleased to learn of your interest in No FEAR Data. I have since come to regret my naiveté in light of the apparent hidden agenda. For your information, the government has been reluctant to provide No Fear data. It is only through the sacrifice, including firing, illness and deaths of dedicated No Fear Coalition members that we have the data that you now characterize as plagiarism. This data is not proprietary to any organization. In a free democratic society any citizen has the right to request information under FOIA.

No rational mind would attribute a request by any citizen or organization as plagiarism.
I consider your e-mails as defaming and they should cease immediately.
I have no interest in working with you or David and will consider any further contact as harassment.

I have never shied away from the truth or what I think is right. I am engaging myself because it is the right thing to do even though I hate to waste energy on all the negativism that does nothing but waste time from the serious problems involved in civil rights and whistle blowing. The politicking and in-fighting are horrible among some of the groups that are supposed to helping complainants and whistle blowers. I really don't know either of you having just seen a few emails over the past two weeks. I think attacking people via email is inappropriate, unless you have a hidden agenda, it's way out of line. So far Tom and Marsha have been attacked, so the only question is who is next on your agenda?
I believe you both owe Marsha an apology that should be sent to all the people you emailed and blind carbon-copied in an effort to destroy her credibility and standing among her colleagues. I dislike this type of behavior intensely having observed it in many ineffective communities and organizations over the years.
Unfortunately, I believe you have gone off the deep end without adequate information. I was unwell for several days, along with taking care of some of the conference details, so I did not address any of my emails. I am going to address each matter you raised and be done with it:
1. We thought either you or David would be attending some of the sessions and would definitely be at the Press Conference session held today. Evy, you may not recall, but you said that you were going to try to come to DC for the conference, but since you are in California, you understandably may not come, but David would be there to give your report on HHS. At no time did I or Marsha ask you to come and spend your money to do so, as you suggested in one of your emails. We fully expected David to come, but he also said he had a prior commitment. We did not cut anyone out of doing anything.
2. Since neither of you were able to attend, I personally added the following into my speech, "Recently, two advocacy organizations, MSPBwatch and Whistlewatch, broke the news that the Department of Health and Human Services failed to submit annual reports to Congress for 10 years IAW the No Fear Act. They uncovered this by requesting the reports under the Freedom of Information Act and wondered why no one is incensed by this violation of law in the nation's capital. If EPA is any indication, no one seems to care about violations of the civil rights laws." As my sister would say, "What do you want - a medal or a monument?"
3. Marsha Coleman-Adebayo did not attempt to STEAL (plagiarize) or "misappropriate" the information you uncovered about HHS and DOT. After reviewing the press releases, the only sentence that we could come up with is one written by me in which I said we were going to ask for reports under FOIA and review as a committee. Marsha simply used the sentence I wrote, if that is what you are considering plagiarism.
4. The sentence came about because we were supposedly working together to get the information necessary under FOIA from the agencies to out the violators; David even sent me the draft letter he prepared to get the reports for us to use. We talked later because he had only two agency reports available on his web site out of the entire list of Departments/Agencies.
5. I also decided that the No Fear Institute would have more clout in getting the reports quicker than my organization and then we would compare notes with your findings. I appreciate everyone wanting to get credit for their ideas and findings, but what is the point here? I misunderstood and thought it was about violations, not taking credit for uncovering the violations, even though I gave you credit. There is no end to the violations under the Civil Rights Act and No Fear Act - this is just one of many.
6. I have over 25 years of experience in civil rights and as a hobby review agency reports on complaints. I had already downloaded the agency reports on line. I also know many of the civil rights officials because this is a small community. I checked one agency that I thought would have excellent reports and noticed the Report to Congress with the type of data that I was interested in, such as discipline, costs for complaints, fees and an analysis of trends. I was sure that the other agencies did not comply and knew that EPA did not to my knowledge.
7. I am sorry that these mean-spirited emails have destroyed any relationship or work that we could have done together.

We have not met, but it appears we all have the same concern of making the federal government more accountable to the taxpayers.
I was very dismayed to receive the e-mail you sent accusing Dr. Coleman-Adebayo of allegations noted in your e-mail I received.

Over a decade ago, I attended the hearing where Dr. Coleman-Adebayo testified before Congress to make it possible to implement the NO FEAR data requirements. I also participated in the first No FEAR Whistleblower Week In Washington event which she spearheaded under Rev. Walter Fauntroy's leadership. On many occasions I sat with Dr.Coleman-Adebayo and Congressional Staffers to create language that would provide for the collection of No FEAR Data. I share this with you - not to be antagonistic, but rather to let you know that I am most aware that the collection and analysis of NO FEAR data has always been within Dr.Coleman-Adebayo's scope as Chair of the No FEAR Coalition.

Grassley follows up with USDA about discrimination claims

WASHINGTON – Senator Chuck Grassley has asked the U.S. Department of Agriculture for a status report on the agency's effort to improve its process for resolving discrimination claims made by employees following independent assessments that recommended improvements in 2008 and 2011.

"The discrimination issues and delays in resolving claims are not a new issue for the Department of Agriculture, but it's time for a clear indication that systemic problems are being resolved. To date, the agency response to questions about progress being made have been somewhat vague and inadequate," Grassley said.

The Iowa senator made his request for a status report in a letter sent today to Agriculture Secretary Tom Vilsack. Click here to read Grassley's letter to Vilsack.

Both a 2008 report of the Government Accountability Office, which is the investigative arm of Congress, and a 2011 Jackson Lewis report commissioned by the Department of Agriculture identified problems in the way the agency managed employee claims of discrimination and made recommendations for improvements.

Prop Me Up on My Leaning Side

Every time I am asked to pray, I think of the old fellow who always prayed, 'Lord, prop us up on our leaning side.' After hearing him pray that prayer many times, someone asked him why he prayed that prayer so fervently.

He answered, 'Well sir, you see, it's like this...I got an old barn out back. It's been there a long time; it's withstood a lot of weather; it's gone through a lot of storms, and it's stood for many years.

It's still standing. But one day I noticed it was leaning to one side a bit.

So I went and got some pine poles and propped it up on its leaning side so it wouldn't fall.

Then I got to thinking about that and how much I was like that old barn. I've been around a long time.

I've withstood a lot of life's storms. I've withstood a lot of bad weather in life, I've withstood a lot of hard times, and I'm still standing, too. But I find myself leaning to one side from time to time, so I like to ask the Lord to prop us up on our leaning side, 'cause I figure a lot of us get to leaning at times.

Sometimes we get to leaning toward anger, leaning toward bitterness, leaning toward hatred, leaning toward cussing, leaning toward a lot of things that we shouldn't. So we need to pray, 'Lord, prop us up on our leaning side, so we will stand straight and tall again, to glorify the Lord.'


If you stare at this barn for a second you will see who will help us stand straight and tall again. Do you see HIM?

    XXXXXXXXX- Native American Apprentice firefighter, Sequoia National Forest.
    Alicia lives on the Tule River Indian Reservation in central CA. In her 2-½ years as an employee on the Sequoia National Forest the following has been done to her:

    1. Continual pressure from male coworkers to have sex.

    2. Forced to tell her supervisor every month when her period started.

    3. Forced to urinate outside of the crew vehicle in front of the men because they refused to stop at rest stops.

    4. Physically assaulted by a male firefighter.

    5. Attempted sexual assault by a male firefighter while at a fire incident.

    6. Constant sex talk such as, "You'll suck your way to the top."

    7. A group of male firefighters wrote, "XXXXXXX is a whore" on 8 1/2 x 11 papers and threw them all over the Engine Bay for her to find.

    8. Phone calls from male firefighters with explicit, graphic sex talk while men laughed in the background (we have the voice mails).
    9. Denied equal treatment and the same learning opportunities as male coworkers and told she shouldn't be a firefighter because she is a woman.
    10. Native American slurs.

    There are dozens more egregious incidents I could include in this summary on XXXXXX. The Forest Service has performed ONE criminal investigation and TWO administrative investigations at my insistence but no disciplinary action has been taken against any employee (except XXXXXXX). In July 2011, XXXXXXX had a face-to-face meeting with USDA Deputy Assistant Secretary Robin Heard who indicated she would correct the situation and settle XXXXXXXX EEO complaint to get her out of the fire organization and away from the perpetrators. Instead, after XXXXXX reported sexual harassment at the Apprentice Academy Robin Heard was personally involved in the decision to kick XXXXXXX out of the Fire Academy just 4 days before she would have graduated. All of the male harassers were allowed to finish the Academy, graduate and get converted to firefighter positions.
    XXXXXXXX– Hispanic female (former) firefighter, Eldorado National Forest.
    XXXXXX worked on the Eldorado National Forest in the Placerville, CA area. She is a veteran who was deployed to Iraq. She learned firefighting in the military and decided to pursue that career as a civilian. XXXXXX states that she worked with hundreds of men on a Navy ship for months at a time and was treated with respect and dignity but when she joined the Forest Service many of her male coworkers did everything they could to humiliate her, threaten her and run her out of the fire organization. She endured the following:
    1. Hispanic slurs, including being told her skin looked dirty.
    2. Denial of equal opportunities and told women should not be firefighters by her supervisor.
    3. Physical assault – her male supervisor approached her from behind when she was cutting fire line and threw her to the ground. She landed on her stomach and he stomped on her back with his booted foot to prevent her from rising. When she got up he tried to throw her to the ground a second time. This was witnessed by another male firefighter who was terminated from employment as reprisal for supporting her complaint.
    Forest and regional management covered up the incident and forced XXXXXX to continue working with the man. XXXXXX was frightened and contacted The Coalition for help. I insisted upon a proper investigation and accountability. The male supervisor made further threats against XXXXXX and employee witnesses. The agency did not take action on those threats. It took months before the agency acted. XXXXXX participated in the October 4, 2011 Coalition of Minority Employees meeting with Secretary Vilsack. He apologized to XXXXXXX for the agency not taking proper action and told her he personally insured the man was terminated. XXXXXXX had to correct him and advise that the man was still not fired. He has since been terminated. XXXXXX career dream was to be a firefighter. Because of the sexism and assault on her and incidents she witnessed other women going through she left the fire organization and went into Recreation. The reason for this in her words, "To be safe." She also had to move to another forest and currently works on the Tahoe National Forest.
    XXXXXXXXX– Logging Systems Planner, Plumas National Forest
    XXXXX is in a "traditional" male position in the Timber organization on the Plumas National Forest in Quincy, CA. Because she is a woman in what the Forest Service calls a "non-traditional role" she is treated as a less valued employee. She is a lead Class Agent for the Vercruysse Class Complaint filed in March 2011. She has endured:
    1. Years of being denied equal opportunities that are given to male employees or wives of the male employees.
    2. Unequal treatment in promotions; details; training; mentoring.
    3. Isolation and being undermined by male coworkers and managers.
    4. Work being removed and given to male employees. Disrespect of her knowledge, skills, and abilities.
    5. Region 5 management's refusal to properly classify her series and grade level resulting in inability to qualify for promotional positions.
    6. Threats and name-calling. A male Human Resource Officer called her a pig and recommended to her District Ranger (manager of the district) that he et in her face and "menace" her.
    7. Management allowed/encouraged a coworker to threaten, intimidate, and harass her.
    8. Provided unsatisfactory performance evaluations to prevent her from being competitive in promotional opportunities.
    9. Threats of misconduct, discipline, removal of duties and unfunding her position.
    10. Reprisal for filing the Class Complaint.
    XXXXXXX has applied for dozens of promotional opportunities throughout Region 5 and lost them to males. Prior to filing the class complaint we spent many hours speaking with Regional Office and Washington Office officials on discrimination and civil rights violations and ways to remedy the problems. Instead of working to correct the problems they retaliated against her, forcing her to file the class action complaint. XXXXXX has had numerous conversations with Deputy Assistant Secretary Robin Heard about the issues. Ms. Heard initially said she wanted to settle the class complaint but she and the Office of General Counsel (OGC) ultimately refused to discuss any resolution. Thousands of taxpayer dollars have already been wasted due to the agency refusing to discuss a settlement of administrative actions that would correct the problems.
    XXXXXXXXX
    was a supervisory firefighter until the Agency arbitrarily removed her supervisory authority. She became pregnant with twins and the agency forced her to work in a dungeon-like basement office that was overrun by mice and mice feces. This was a danger to her health and the health of her babies. The agency refused to move her from the office until The Coalition contacted Governor Jerry Brown's office. Governor Brown's Disease Vector Control personnel were so concerned that XXXXXX was at risk for getting Hanta Virus that they called the Forest Service to remedy the situation. The Forest Service has treated other Native American employees have been similarly.
