I put this together...Jeanette did not...so blame me for any false conclusions, inaccuracies,
omissions or assumptions !
FEDERAL WATER POLLUTION CONTROL ACT
TITLE 33—NAVIGATION AND NAVIGABLE WATERS
CHAPTER 26—WATER POLLUTION PREVENTION AND CONTROL
[As Amended Through Pub.L. 111-378, January 4, 2011]†
(33 U.S.C. § 1251 et seq.)

The PDF is 132 pages. The significance of the latest provisions that have some
researchers so concerned is the modification of the term "navigable waters" you'll
see below in (7) ! Yes, the PDF was published by California, but is applicable all
over the U.S. and it is keyword searchable within the document.
"Navigable waters" has been expanded to include any water anywhere that flows...
even periodic mud puddles and periodic water that can move something as insignificant
as a "leaf" or a "blade of grass" on the ground ON YOUR OWN PROPERTY !
Pay attention to Sec. 502 (7) under the definitions
...SEC. 502. [33 U.S.C. 1362] DEFINITIONS
Except as otherwise specifically provided, when used in this chapter:
(7) The term "navigable waters" means the waters of the United States, including the territorial seas.
You'll see that the word "waters" is undefined ! That's their out when they come onto YOUR land
to assert their jurisdiction over YOUR land. The fact that the word "waters" is open ended and with
NO exclusions for private property...should alert you to the future escalation of the governments control.
It may not be invoked today, but what are the odds that they don't invoke it tomorrow. It's not as if their track record for encroachment on private property, etc. has ever NOT happened, eh ?
And...
SEC. 102. [33 U.S.C. 1252] COMPREHENSIVE PROGRAMS FOR WATER POLLUTION CONTROL
(a) PREPARATION AND DEVELOPMENT—The Administrator shall, after careful investigation, and in cooperation with other Federal agencies, State water pollution control agencies, interstate agencies, and the municipalities and industries involved, prepare or develop comprehensive programs for preventing, reducing, or eliminating the pollution of the navigable waters and ground waters and improving the sanitary condition of surface and underground waters.
And the following definition is from a legal report from 2007:

• Streams are linear geographic features that convey flowing waters.
Headwater streams are the uppermost, low-order streams of a watershed
and comprise the majority of streams in the United States, both in
terms of numbers and length. Streams can be perennial, ephemeral, or
intermittent.

The above definition doesn't distinguish between public and private property ! If you have
any flowing water at ANY time on your property, then your property is subject to
the control of the ACT !
